Terms & Conditions

Introduction

1. The FIVE SENSES website (hereinafter: “the Website” and/or “the Business”) is an online sales platform in the field of fashion and design.
2. The use of the masculine form is for convenience only and refers to all genders.
3. These Terms of Use, together with the Privacy Policy and Cookie Policy (collectively: “the Terms of Use”), constitute a binding agreement between the Business and any user of the Website.
4. The Business reserves the right to update or modify these Terms of Use at its sole discretion and without prior notice.
5. The Website is provided to the public on an “As Is” basis. Errors or inaccuracies may occur in good faith, and the Business shall not be held liable for them.
6. The Business and/or its representatives shall not be liable for any direct, indirect, or consequential damages caused to the user and/or to any third party as a result of using the Website.
7. The Business’s records, including electronic records, shall serve as conclusive evidence of the accuracy of transactions made on the Website.
8. The user undertakes to provide accurate and complete information when placing an order on the Website.
9. The user is personally responsible for his/her use of the Website. Any breach of law or of these Terms may result in the Business denying the user access to the Website.
10. All prices displayed on the Website include VAT, unless stated otherwise.
11. The user declares that he/she is over 18 years of age. Orders made by a minor require parental or guardian approval.


Website and Products

1. The Website offers original fashion products designed by FIVE SENSES, including clothing, shoes, bags, and accessories.
2. All products are produced by the Business and/or its suppliers in accordance with strict quality control standards.
3. Product images on the Website are for illustrative purposes only. Minor differences in color, size, or details may occur between the product as displayed and the actual product.
4. The customer bears sole responsibility for selecting the correct size, color, and model.


Purchases on the Website

1. Purchases may be made using the following payment methods:
• Credit cards (subject to approval by the credit company).
• PayPal.
2. The Business may update, add, or modify available payment methods from time to time.
3. Upon completing an order, an email confirmation will be sent with the order details.
4. The Business reserves the right to discontinue the sale of any product or deny a customer’s right to purchase at its sole discretion.


Cancellation and Returns

1. Customers are entitled to cancel a purchase in accordance with the Israeli Consumer Protection Law, 1981.
2. Cancellations may be made within 14 days of receiving the product, provided it has not been used and is returned in its original packaging.
3. For products made to order or custom-made, cancellations or returns will not be accepted, except in the case of a manufacturing defect.
4. In case of cancellation, refunds will be made subject to:
• Cancellation fees of 5% of the transaction amount or 100 NIS (whichever is lower).
• Actual shipping costs, even if free shipping was provided to the customer.
5. Refunds will be processed within 7 business days from receipt of the returned product.
6. The customer is responsible for returning the product in proper packaging and at his/her own expense.


Shipping and Delivery

  1. Processing Time: Orders are processed within up to three (3) business days from the date of purchase, excluding weekends and holidays.
  2. Delivery Time – Israel: Delivery within Israel is estimated at up to seven (7) business days from dispatch, depending on the selected delivery option and destination.
  3. Delivery Time – International: Delivery times for international orders vary according to the destination and chosen shipping method (Economy or Express). Estimated delivery times are displayed at checkout.
  4. Delivery Services: Shipments are carried out by independent third-party courier or postal companies (such as UPS, Ecopost, EMS, or FedEx). The Business shall not be held liable for any delays or issues caused by such third parties or circumstances beyond its control.
  5. Customer Responsibility: The customer must provide a full, accurate, and up-to-date delivery address and contact details. Errors or incomplete information may result in delivery delays or additional shipping charges.
  6. Missed Deliveries: If the courier is unable to complete delivery due to the recipient’s unavailability, re-delivery attempts may be made according to the courier’s policy. Parcels returned to the Business following unsuccessful delivery attempts may incur additional shipping fees.
  7. Leaving Parcels: Requests to leave a parcel unattended (e.g., at the door or with a neighbor) are at the customer’s sole responsibility. Once a parcel has been marked as delivered or a collection notice has been issued, the Business shall not be held liable for loss, damage, or delays thereafter.


Warranty and Service

1. The warranty applies to manufacturing defects only.
2. The Business shall not be liable for damages caused by improper use of the product.
3. The warranty does not cover natural wear and tear resulting from reasonable use.


Data Security and Privacy

1. The Business undertakes to protect customer privacy in accordance with the law.
2. Credit card details are not stored in the Business’s databases.
3. Personal data provided during the order process will be used solely for processing the order, providing service, and marketing (subject to consent).
4. The Website uses cookies for operational, analytical, and marketing purposes. Customers may block cookies via their browser settings.


Governing Law and Jurisdiction

1. The interpretation and enforcement of these Terms shall be governed exclusively by Israeli law.
2. Exclusive jurisdiction for any dispute lies with the competent courts in the Central District of Israel.
